California Privacy Notice (CCPA)

This region specific privacy notice ("Notice") applies to all the products, services, websites and apps offered by SurveyMars. SurveyMars refers to these products, services, websites, and apps collectively as the "services" in this policy. This Notice is an extension to and forms part of the main SurveyMars Privacy Notices.

This Notice describes the rights of individuals who are California residents under the California Consumer Privacy Act of 2018 ("CCPA"), and residents of other states or regions in the United States of America with similar applicable privacy laws who interact with SurveyMars as a Service Provider. While we have set out the categories below as required by the CCPA and similar privacy laws, you can review our SurveyMars Privacy Notices for examples and other information that describes our data collection and use, as previously disclosed to you which have not changed under this Notice.

This Notice does not apply to personal information we collect from our employees or job applicants in their capacity as employees or job applicants. Employees and job applicants should refer to our Employee Privacy Notice or Candidate Privacy Notice, respectively.

Except for residents of California, it also does not apply to personal information we collect from our employees, owners, directors, officers, or contractors of businesses in the course of our provision or receipt of business-related services.

1. Your Privacy Rights

Subject to certain restrictions, if you are a resident of California and states with similar privacy laws, you may have the right to request that we:

  • Confirm that we are processing your personal information or disclose what personal information we collect about you;
  • Delete any personal information that we collected from or maintain about you;
  • Correct inaccurate personal information we maintain about you;
  • Opt you out of any "sale" or "sharing" of personal information about you;
  • Opt you out of the processing of personal information for purposes of targeted advertising or profiling in furtherance of decisions that produce legal or similarly significant effects concerning you;
  • Limit the use or disclosure of sensitive personal information if used or disclosed for reasons other than those permitted by the CCPA;
  • Not discriminate against you for exercising any of these rights.

Applicable laws may also give you the right to designate an agent to exercise these rights on your behalf. This section describes how to exercise those rights and our process for handling those requests, including our means of verifying your identity. Right to request access to your personal information

You have the right to request access to your personal information at Contact Us | SurveyMars. Under the CCPA and similar privacy laws, you can also request that we disclose: the categories of personal information that we have collected about you; the categories of sources from which the personal information was collected; the business or commercial purpose(s) for which personal information was collected or "sold"; the categories of third parties with whom we share personal information; the categories of personal information that may have been "sold", and the categories of third parties to whom the personal information was "sold" (if applicable); and the categories of personal information that we disclose for a business purpose, and the categories of third parties to whom the personal information was disclosed (if applicable).

However, as permitted under the CCPA, we may withhold some information where the risk to you or your personal information is too great to disclose the information, such as financial information or account passwords.

Right to request deletion of your personal information

Subject to certain exceptions under applicable law, you have the right to request deletion of your personal information at Contact Us | SurveyMars that we have collected from or about you. However, we may retain personal information as authorized under applicable law, such as personal information required or necessary to provide our services, to protect against fraudulent activity, to identify and fix bugs, to exercise our or another person's free speech or other rights, to comply with law enforcement requests pursuant to lawful process, for scientific or historical research, for our own internal purposes reasonably related to your relationship with us, or to comply with legal obligations. We need certain types of information so that we can provide our services. If you ask us to delete it, you may no longer be able to access or use our services.

Right to correct inaccurate personal information

Subject to certain exceptions under applicable law, you have the right to request that we correct inaccurate personal information that we maintain about you.

How to exercise your rights

You may exercise your access and deletion rights by submitting your request at Contact Us | SurveyMars. While our Contact Us | SurveyMars is the best way to reach us, you may also email us at SurveyMars Privacy Notices. For security purposes, we may request additional information from you to verify your identity when you request to exercise your rights related to your personal information.

If you have an online account with us, logging into your account will serve to verify your identity and request. If we have reason to suspect that the security of your account is compromised, we will request additional information from you to match with our existing records to verify your identity, depending on the nature of the request and the sensitivity of the information sought.

Once you submit a request (1) to access the categories of personal information we have about you or (2) to obtain a copy of specific pieces of personal information we have about you, we will ask that you verify your identity by logging into your account using your username and password. There, we will provide you with your information in a password-protected format.

To request that we delete personal information we have collected from you, you will need to authenticate with us by first logging into your account using your username and password on file with us and deleting your account. Once you let us know you have taken this action, we will initiate the deletion process.

Most personal information can be corrected within your account. If you need instructions on how to do so, please contact us at Contact Us | SurveyMars.

If you wish to exercise any of these rights and do not have an account with us (for example if you are an authorized agent submitting a request on behalf of another individual), please contact us at Contact Us | SurveyMars and we will request additional information to verify your identity where possible.

If we deny your request in whole or in part, you may have the right to appeal the decision. In such circumstances, we will provide you with information regarding the appeals process.

Right to non-discrimination for exercising your rights

The CCPA and similar privacy laws may prohibit us from discriminating against you for exercising the rights described in this section. Such discrimination may include charging different prices for our services, providing or suggesting that you will receive a different level or quality of services, or refusing to provide services to you if you exercise your rights.

2. Categories of Personal Information We Collect and the Sources

We collect the following categories of personal information:

Registration information

When you register an account on surveymars.com, we will collect your email address. If you choose to authorize a third-party account (Google) to log in, you will also authorize us to obtain the account information you actively share from the third party for quick registration/logging in as a registered user of SurveyMars.

When your account is successfully registered, when you use the services provided by SurveyMars, we may also collect your personal information including other contact details, IP, location, device, OS information, and certain other information reasonably necessary to help you better use the services provided by SurveyMars.

Billing information

When you make a payment on https://surveymars.com in your preferred payment method, you are required to provide billing details, such as name, billing address, and financial information (like credit card details).

Credit card processing: The third-party service providers accessed by banks, such as Visa and UnionPay, collect your credit card information on our behalf in order to process the payments you pay to us. We do not store any such information pertaining to your credit card.

This third-party intermediary shall not use or retain billing information for any purpose other than that is permitted for processing the payment and related legitimate interests. By providing such information, you represent and warrant that you are the owner of such personal information or otherwise have requisite consent to provide it to us.

Usage information and Account settings

Whenever you use our websites and services, we may collect usage information about you like the webpages you visited, language preferences, etc. You can set preferences on the account settings page regarding your default language, timezone, and branding preferences.

Media content/files

When you create a questionnaire, if you need to import documents, media content, etc. in the questionnaire, you need to authorize SurveyMars to open your memory card content (including but not limited to SD card, TF card, MMC card, etc.) to read the media content and files on your device; If you need to customize the appearance of the questionnaire or insert images, audio, or video into the questionnaire, you need to authorize SurveyMars to turn on your album or camera function to read the album or gallery on your device; If you need to quickly edit the survey content by converting it to text, you need to authorize SurveyMars to enable your microphone permission to record audio.

Share the information you need to collect to answer your questionnaire

Address book information: You can import email addresses into the audience and make use of it to invite people to take part of your surveys. We don't use the email addresses you have stored for our own purposes.

Link sharing, custom parameter link sharing, QR code, social platform sharing, etc.: When you choose to use the generated poster or QR code sharing method, license us to open your photo album function; When you choose to share the questionnaire by skipping to the third-party application platform, you will authorize us to obtain the account information you actively share from this third party. If you refuse to share your questionnaire through the SurveyMars jump third-party application platform, you can copy the questionnaire link and QR code and directly log in the third-party platform and share the questionnaire. If you wish to share your questionnaire through a third-party application platform, you need to authorize us to open your device application list to read the applications you have installed, so that we can know that you can share the questionnaire to the list of third-party application platforms installed, so that you can successfully share the questionnaire through the third-party application platform.

Other information

We collect information from you through testimonials, case studies, forms, or information you intentionally share with us in other contexts.

Custom domain name: You can actively fill in your SurveyMars secondary domain name or private domain name in the "User Information" - "Custom Domain Name" page (to meet the relevant regulations as a valid own domain name), so that we can bind the domain name for you to help you to build an exclusive questionnaire service platform.

Set the password answer: When you use SurveyMars to release a questionnaire, you can take the initiative to upload (please note that before uploading respondent personal information, you must pass the consent or authorization of the respondent) respondent personal information (email address or third-party account and other personal information) of any as a questionnaire answer password, in order to achieve accurate respondent answers.

User Information Form: When you use the user information form function in the user system to publish the questionnaire, you need to actively import the respondent list (please note that you must obtain the consent or authorization of the respondent before importing the list). The list may contain the respondent's name, contact information, or other personal information.

Sub-account: When you need to create a SurveyMars sub-account, you need to provide a new (different from the main account) email address to create a SurveyMars sub-account, and we will verify that the email address you provide is valid.

Note: We don't share or abuse your respondents' email addresses. SurveyMars will not email your survey respondents or subscribers in your list except at your direction. We don't sell or share the email addresses in your list to any third parties.

User Details

User details such as IP, location, device information, and browser information and its activities will be tracked when a user is interacting with our application. We also track referral information, meaning we also track how the user landed into SurveyMars.

Event Logs

A log of all requests generated by the user is maintained to debug in case of any emergencies. This includes user information such as IP, location, OS information, browser, device type, and the time which the user interacted with the platform. These log files are encrypted and rotated frequently.

Information we collect from Third-parties

SurveyMars may collect your personal information from third parties to whom you have given your personal data sharing permissions.

Survey data

Your survey data (questions, responses, and audience list) is stored with us. Your survey data is yours. SurveyMars grants you the admin role to collect and export the responses as you wish. We do not sell or use survey responses collected by you for our business requirements.

You, as the configured survey creator, are the collector and controller of the data filled in, and the data you collect may contain personal information of other subjects such as the respondent. You enjoy the use and control of the collected questionnaire data, we only provide you with technical services for questionnaire data recovery, storage, and statistics, so that you can retrieve and analyze the use at any time. Without your consent, we will not use, process, transmit, and share your questionnaire data beyond the provisions of laws and regulations and the scope authorized by this policy.

Others

We safeguard survey respondents' email addresses and the email addresses collected by you. We don't use or sell the email addresses against our policy.

Other parties, including when you give permission to social networks to disclose your information with us or where you have made your personal information publicly available online.

The security of your personal information and data is important to us. We store them securely. We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once it is received. Survey data is stored on servers located either in the United States as specified by you. We will process your survey data on your behalf and under your instructions.

If you interact with our site as a respondent, all of your response data is controlled by the person or business who sent you the survey/form/application/questionnaire (the "Creator") and we recommend you contact them about their practices under the CCPA and similar privacy laws, as SurveyMars processes this response data on the Creator's behalf and the Creator - not SurveyMars - is responsible for responding to your request.

3. Purposes of Collection, Use, and Disclosure

We collect, use, and disclose all of the categories of personal information and sensitive personal information (as detailed above) for the following commercial or business purposes:

  • Providing our services (for example, account servicing and maintenance, customer service, advertising and marketing, analytics, and communication about our services);
  • For our operational purposes, and the operational purposes of our vendors and integration partners;
  • Improving our existing services and developing new services (for example, by conducting research to develop new products or features);
  • Helping to ensure security and integrity to the extent the use of the consumer's personal information is reasonably necessary and proportionate for these purposes;
  • Debugging to identify and repair errors that impair existing intended functionality;
  • Auditing related to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with this specification and other standards;
  • Short-term, transient use, such as customizing content that we or our vendors display on the services;
  • Other uses that advance our commercial or economic interests, such as third-party advertising and communicating with you about relevant offers from third-party partners;
  • Other uses that we notify you about.

We do not use or disclose sensitive personal information for purposes other than for those purposes for which you cannot opt out under the CCPA.

4. Data Retention

We retain your personal information for the periods described in our SurveyMars Privacy Notices and Terms of Use.

5. Your Choices for Advertising Cookies

The CCPA requires businesses that "sell" or "share" personal information, as the terms "sell" and "share" are defined under the CCPA, to provide California residents the right to opt-out from such sales or sharing. Sale and/or sharing are defined in such a way that may include allowing advertising vendors to receive certain information (such as cookie identifiers, IP addresses, and/or browsing behavior) to add to a profile (about your device, browser, or you). Such profiles may enable delivery of interest-based advertising by such advertising vendors within their platform or on other sites. When you visit our website, we may share the following categories of information for such interest-based advertising, which may be considered a "sale" or "sharing" as defined by the CCPA: (1) device information and identifiers, such as IP address and unique advertising identifiers and cookies; and (2) connection and usage information, such as browsing history or app usage. We engage in such practices to provide you with more tailored marketing content (about our services or other services), and to evaluate whether this content is useful or effective. You may opt-out of such advertising cookies on a go-forward basis within our cookie banner or by clicking "Do Not Sell or Share My Personal Information" in the website footer. Please note that if you are using an ad-blocker, the ad-blocker may hide the cookie banner and footer link.

We do not "sell" or "share" sensitive personal information, as those terms are defined by the CCPA.

Please note that we also respond to and abide by opt-out preference signals sent through the Global Privacy Control. Any opt-out preferences you have exercised through this method will only apply to the specific device/browser on which you made them.

Please note that Do Not Track is a different privacy mechanism than the "Global Privacy Control" browser choice referenced above, which is a browser-based control that indicates whether you would like to opt out of processing of your personal information for online behavioral advertising purposes.

Our services are not directed to consumers under 16 - and such minors are not authorized to use our services - so we do not knowingly "sell" or "share" the personal information of consumers under 16 years of age.
